Day 1 Rights; Probation Matters! (UK Employment 2025)

All businesses large and small should be aware of the changes to the employment law in relation to the rights of an employee when they can claim unfair dismissal.

Until the law was changed, and unless you had a protective characteristic, you couldn’t claim unfair dismissal for 2 years. In 2026 when this bill becomes law and is enforced then it will be day one protection. As such, the required two year protection is gradually decreasing from date of employment until the new law takes effect.

This makes the probation period so much more important and why I stress the need of having good probation period performance reviews if you’re a small company.
