I was angered recently when I saw a TikTok video that had gone viral for showing someone being dismissed for poor performance. The employee had no inkling that they were not meeting company expectations and had never met the two bosses before.

While I understand that not all new employees show the promised capability once in post, some kind of discussion and potential time for improvement should occur before considering dismissal.

As an HR consultant, I would remind employers to assess the risk of a tribunal claim and consider the five fair reasons to dismiss:

  • Conduct
  • Capability
  • Redundancy
  • Statutory Restriction
  • Some other substantial reason (SOSR)
